Once one of Amazon India's largest sellers, Appario Retail has filed a lawsuit against the Competition Commission of India (CCI), challenging the ongoing antitrust investigation that accuses the e-commerce giant of unfair competition practices.
According to a media report referring to the court documents filed on September 26, Appario, previously a top seller on Amazon's platform, aims to have the CCI's antitrust report set aside. This report reportedly accuses Amazon of breaching competition laws by favoring certain sellers and manipulating listings.
Appario's legal action represents a significant milestone, as it marks the first formal challenge to the four-year antitrust investigation against Amazon India and Flipkart, both of which are facing scrutiny for alleged anti-competitive practices.
What is Appario's Role in the CCI Investigation?
The CCI's antitrust investigation began in October 2019, following complaints from the Delhi Vyapar Mahasangh, an affiliate of the Confederation of All India Traders (CAIT). The traders' body accused Amazon and Flipkart of favoring select sellers, which resulted in unfair competition. Appario, a joint venture between Amazon and the Patni Group-owned Zodiac Wealth Management, was among the sellers named in the CCI's report. This investigation gained momentum as it uncovered how Amazon allegedly prioritized specific merchants by offering them discounted fees and privileged access to its global retail tools.
In 2022, CCI's investigation intensified when the watchdog raided Appario and other sellers linked to Amazon. The outcome of this probe has been closely watched by the Indian e-commerce sector, but the final report has yet to be made public. The allegations against Amazon and its top sellers have raised concerns among small and medium-sized businesses, who believe they are being unfairly sidelined on the platform.
Appario's Petition and the Grounds for the Lawsuit
Appario's lawsuit in the Karnataka High Court seeks to challenge the CCI's internal report, which, according to the former seller, wrongly implicates it in the alleged anti-competitive practices of Amazon India. The company is requesting the court to quash the findings and dismiss the investigation against it and Amazon. Although the exact grounds for Appario's suit remain unclear, it is widely believed that the company disputes the CCI's conclusions regarding its involvement in any preferential treatment.
Notably, this legal move comes just days after reports surfaced that the CCI was assessing the turnover of Amazon and Flipkart to determine penalties for antitrust violations. Both e-commerce giants could face fines of up to 10% of their global annual turnover if found guilty of breaking competition laws.
Amazon's Position and Appario's Divestment
Amazon has consistently denied the antitrust allegations, maintaining that it operates within the legal framework of Indian e-commerce regulations. Despite this, media reports have indicated that Appario was internally classified as a "special" merchant within Amazon India, which may have contributed to its preferential treatment on the platform.
In a related development, Appario was sold to Clicktech in July 2023, following the CCI's approval of the transaction. This divestment is part of Amazon's ongoing compliance with Indian e-commerce regulations, which require foreign-owned e-commerce platforms to limit their direct involvement with sellers. Previously, Amazon was also forced to delist another major seller, Cloudtail, which was a joint venture with Infosys founder NR Narayana Murthy’s Catamaran Ventures.
Impact on E-Commerce and the Road Ahead
As the legal battle unfolds, the outcome of Appario's lawsuit could have far-reaching implications for the Indian e-commerce landscape. Both Amazon and Flipkart have consistently maintained that they comply with all applicable regulations, yet the allegations of unfair competition have fueled long-standing debates among small traders and online sellers.
The Karnataka High Court has yet to schedule a hearing for Appario's petition, leaving the industry in suspense. Meanwhile, Amazon and Flipkart have already launched their festive season sales, continuing to dominate the e-commerce market in India. Whether the antitrust investigation will result in penalties or reforms remains to be seen, but the stakes are undoubtedly high for both the platforms and their sellers.
